Description of the Assignment: National expert on EU Corporate Sustainability Due Diligence Legislation (national implementation)

Duty Station: home-based

Period of assignment/services (if applicable): September – December 2024

!PLEASE NOTE: the currency of the proposal is UAH. Furthermore, UNDP will enter into a contract with the selected national consultant in UAH.

Main objectives of the assignment: to conduct legal analysis and provide expert support to the Government of Ukraine in implementing the regulations and setting up administrative procedures to comply with the EU Corporate Sustainability Due Diligence Directive to accelerate the achievement of the SDGs by private sector in Ukraine.

Scope of work:

It is expected that in terms of implementation of this assignment, the Consultant/Expert (Individual Contractor) will carry out the following activities:

  1. Develop a report analyzing the implications for Ukraine as a candidate country for EU membership, as well as for the Ukrainian private sector, of the EU Corporate Sustainability Due Diligence Directive (CSDDD) taking into account the broader EU framework on corporate respect for human rights. The report should suggest strategies for implementing the regulations and setting up the administrative procedures to comply with CSDDD, its incorporation into Ukrainian legislation, economic and trade policies, and recovery initiatives. The report should be tailored for use by the Government of Ukraine and the private sector. The report should also highlight how implementing the CSDDD can drive progress towards achieving SDGs, particularly Goals 5, 8, 9, 10, 11, 12, 13, 16, and 17.
  2. Provide inputs to the (1) discussion paper for the high-level meeting with business representatives on CSDDD implications outlining how Ukrainian businesses can be able to scale up their business operations while respecting human rights and environmental due diligence in line with CSDDD and broader frameworks for corporate respect for human rights, and (2) report with survey results outlining gaps, challenges, and opportunities for Ukrainian private sector to align with CSDDD requirements. The discussion paper should outline how Ukrainian businesses can contribute to the achievement of SDGs through compliance with CSDDD, emphasizing Goals 5, 8, 9, 10, 11, 12, 13, 16, and 17.
  3. Provide inputs to analytical and learning materials for Diia.Business platform to support private sector in implementing corporate sustainability due diligence under CSDDD (informational page, self-asessment tool on business and human rights, informational materials tailored for different businesses (including SMEs) from various sectors (energy, transportation, agriculture, critical raw materials, processing industry, and the ICT sector). The materials should include sections on how businesses can align their operations with the SDGs, emphasizing the interconnectedness of responsible business practices and sustainable development, particularly in relation to Goals 5, 8, 9, 10, 11, 12, 13, 16, and 17.
  4. Develop a roadmap outlining concrete steps that the Government of Ukraine (GoU) should take to implement the CSDDD regulations and set up the administrative procedures to ensure alignment of national legislation, policies, and strategies with the CSDDD and the broader EU framework regarding corporate human rights obligations. The roadmap should be consistent with Ukraine’s agenda for EU accession, including the Ukraine Facility Plan and national recovery policies. It should particularly focus on specific sectors critical for Ukraine’s recovery, such as public and private investments, public-private partnerships, private sector development and support, and public procurement. Additionally, it should address sectors highlighted in the Ukraine Facility, including energy, transportation, agriculture, critical raw materials, processing industry, and the ICT sectors. The roadmap should include specific references to how each step aligns with and supports the achievement of SDGs, especially Goals 5, 8, 9, 10, 11, 12, 13, 16, and 17.
  5. Participate in consultations at national level with line ministries, Ukrainian Parliament Commissioner for Human Rights, civil society organizations (CSOs), business and government representatives to present and discuss the developed roadmap, analytical products.
  6. Participate in training sessions, workshops on corporate sustainability due diligence, and other aspects of corporate respect for human rights under EU legislation and broader international frameworks on business and human rights (providing input to agenda and participating as trainer).
  7. Develop suggestions for the future interventions on strengthening corporate respect for human rights in Ukraine (e.g. possible pilot projects / sectors / markets to target and interventions for the GoU, businesses to adhere to the EU and broader international frameworks on business and human rights).

All final products should be produced according to the plan outlined under each deliverable as specified in the Terms of reference.
