1. PROJECT BACKGROUND
The purpose of the US Agency for International Development (USAID) Cybersecurity for Critical Infrastructure in Ukraine Activity is to strengthen the resilience of Ukraine’s critical infrastructure from cyberattacks by establishing trusted collaboration between key cybersecurity stakeholders in the government, private sector, academia, and civil society. The activity aims to achieve this goal by implementing the following activity components:
Component 1: Strengthen the cybersecurity enabling environment
The legal, regulatory and institutional framework for national cybersecurity in Ukraine needs to be strengthened and aligned with international standards and best practices. This component will strengthen the cybersecurity resilience of Ukraine’s critical infrastructure sectors by addressing legislative gaps, promoting good governance, enabling collaboration between stakeholders, and supporting cybersecurity institutions. This component will also build the technical capacity of key sectors through increased access to cybersecurity technology and equipment.
Component 2: Develop Ukraine’s cybersecurity workforce
Ukraine suffers from a severe shortage of cybersecurity professionals. This component of the USAID Cybersecurity for Critical Infrastructure in Ukraine Activity will address workforce gaps through activities that develop new cybersecurity talent and build the capacity of existing talent. These activities will address the entire workforce pipeline, the quality of education received by cybersecurity specialists, and industry training programs to rapidly upskill Ukraine’s workforce to respond to immediate cybersecurity vulnerabilities.
Component 3: Build a resilient cybersecurity industry
A growing cybersecurity industry in Ukraine will contribute directly to national security and prosperity. This component will seek to build trust and collaboration between the public and private sector to develop innovative solutions for future cybersecurity challenges; spur investment and growth in the broader cybersecurity market in Ukraine through greater access to financing; support smaller cybersecurity companies to rapidly increase the number of local cybersecurity service providers; and offer mechanisms for Ukrainian firms to connect with industry partners to enable better access to innovations and business opportunities.
2.Role’s Purpose
Russia’s use of hybrid warfare technologies has transformed the information space into a battleground, leveraging advanced IT to incite divisions, promote aggression, violate Ukraine’s sovereignty, and justify its invasion. Since the full-scale invasion began, illegal “telecommunication providers” in occupied Ukrainian territories have further compromised the nation’s information security through harmful actions.
The goal of this role is to strengthen Ukraine’s cybersecurity and critical infrastructure resilience by addressing the illegal provision of Internet access services to the so-called Donetsk and Luhansk People’s Republics (DPR and LPR) by the Regional Internet Registry RIPE NCC1, a Dutch legal entity. This involves developing strategies in collaboration with Ukrainian authorities, monitoring cooperation between RIPE NCC and the DPR/LPR to assess potential threats, examining legal implications under EU and Dutch law, and providing actionable recommendations to mitigate risks. Additionally, the role aims to foster dialogue and collaboration between Ukrainian and Dutch stakeholders to identify balanced and effective solutions to these cybersecurity challenges.
3.ROLE’s TASKS
The Consultants will work in close collaboration with the Ukrainian government and law enforcement agencies as well as the Dutch prosecution and governmental bodies and perform tasks as assigned by stakeholders. Consultants will perform the following scope:
- Collaborate with the Ukrainian government and relevant authorities to develop strategies for addressing the issue of the provision Internet access services by the Regional Internet Registry RIPE NCC (Dutch legal entity) to the so-called Donetsk and Luhansk People’s Republics (DPR and LPR), sanctioned by the EU;
- Monitor and assess the nature of cooperation between the Donetsk and Luhansk People’s Republics (DPR and LPR) and RIPE NCC to identify potential instances of Internet resource allocation or other forms of collaboration for further investigation;
- Examine the legal framework and potential implications of cooperation between DPR/LPR and RIPE NCC under Dutch and the EU law;
- Provide actionable recommendations for measures to be taken in the Kingdom of the Netherlands in order to mitigate potential threats to Ukrainian cyber security arising from such cooperation between DPR, LPR and RIPE NCC;
- Facilitate dialogue and build collaboration between Ukrainian and Dutch stakeholders by organizing and hosting meeting aimed at identifying balanced and practical solutions to these challenges. .
4.LEVEL OF EFFORT AND REPORTING
It is a deliverables-based ICA. The Consultant will work under the technical direction of the Enabling Environment Lead.
5.QUALIFICATIONS REQUIRED
- Master’s degree in legal or related fields (preferably international law)
- Minimum five (5) years of professional experience in practicing law;
- Experience working with the GOU in cross-border litigation involving the protection of state interests and collecting relevant evidence in the territory of Ukraine and other countries.
- Fluency in English is required. Ukrainian. – native.
