Cybersecurity remains a critical and pressing issue in Ukraine. Successful cyber-attacks could have an irreparable impact to electoral integrity, damaging the foundation of trust in the electoral process and tampering with citizen’s democratic rights. IFES has worked diligently with a range of security and electoral actors to ensure that electoral cyber infrastructure is updated and protected, that civil society have the tools they need to protect themselves, and that Ukraine is constantly learning, adapting and being vigilant to increasingly sophisticated attacks by malevolent actors.

IFES Ukraine requires services of two Digital Transformation Legal Consultants to perform the following tasks:

• Conduct research in the context of the necessity to update the legislature in the sphere of digital transformation, e-services, and processes organized/provided by state bodies,
• Prepare organizational and legal expertise of the tools, mechanisms, and processes being developed in the context of cybersecurity and digital transformation,
• Provide legal knowledge on concepts, terms of references, and other documents in the field of digitalization and digital transformation under the partners requests that demand legislative changes, both substantive and/or procedural,
• Assess legislation on use of ICT tools for public services, provide legal opinions on implementation of international and EU cybersecurity and digitalization standards, in particular the protection of information assets, personal data, etc.,
• describe possible risks of using ICT in public services and/or public authorities procedures and preparing relevant recommendations;
• Draft legislation on the use and implementation of ICT technologies, and any other issues, depending on the request received from the IFES partners;
• Conduct interviews with the crucial IFES Ukraine partners to discuss the necessary updates (CEC, Ministry of Digital Transformation, NSDC, NCCC, Committees of Verkhovna Rada, SSSCIP, SSU, Cyber Police, others).

Deliverables:

• Briefings, comments, reviews, legal opinions and recommendations;
• Notes from the meetings and interviews with stakeholders;
• Draft legislative acts on the use and implementation of ICT technologies, and any other issues of cybersecurity and digitalization, depending on the request received from the IFES partners.

Period of performance: January 26, 2023 – December 31, 2023.

Number of working days: 40 for each consultant.

REQUIREMENTS FOR POTENTIAL CANDIDATES:

Education:

Master’s degree or equivalent is required in law, international law, public administration, data management, personal data protection, computer science, or cybersecurity.

Experience:

• Minimum 10 years of professional experience in working with Ukrainian legislation in privacy, data protection, and cybersecurity, designing and advising on digital policies and legal aspects;
• Demonstrated experience of work with drafting legislative acts on cybersecurity, digitalization, e-services or ICT tools development, experience of implementing projects with international organizations would be an asset;
• Demonstrated expertise in EU acquis on cybersecurity and digitalization, data protection, ICT technologies.

Language:

Excellent/fluent English is required.
