Chemonics International, a global consulting and international development firm, seeks an E-Commerce Expert, short-term position, for the USAID-funded Competitive Economy Program (CEP). CEP is a five-year program to increase the competitiveness of startups and small and medium-sized enterprises (SMEs) in Ukraine, as well as to increase the competitiveness of Ukrainian products in foreign markets, through a combined focus on improving Ukraine’s business enabling environment, increasing private sector competitiveness, increasing access to finance and investments, promoting exports, and facilitating trade.
CEP seeks to hire a short-term E-Commerce Expert (Expert) to support the Ministry of Digital Transformation of Ukraine (MDT) with development of the Law on Electronic Commerce, which implements provisions of Directive 2000/31/EC of the European Parliament and of the Council of 8 June 2000, on certain legal aspects of information society services, in particular electronic commerce, in the Internal Market (hereinafter – Directive on E-Commerce).
The Expert’s responsibilities will include, but are not limited to, the following:
- Review of EU and Ukrainian legislation in the field of e-commerce, taking into account their bilateral obligations.
- Identify gaps in e-commerce legislation in Ukraine regarding non-compliance with the Directive on E-Commerce.
- Prepare an analysis of the draft Law “On Amending the Law of Ukraine “On Electronic Commerce” on creation of the Unified State Web Portal of e-services for consumers in the field of e-commerce” and the draft Law “On Amending the Code of Ukraine on Administrative Offenses” to establish liability for violations of e-commerce legislation” developed by the MDT. This will address gaps in the consistency of the Law “On Electronic Commerce” with the Directive on E-Commerce.
- Based on the analysis, develop recommendations and proposals for the draft Law “On Amending the Law of Ukraine “On Electronic Commerce” regarding creation of the Unified State Web Portal of e-services for consumers in the field of e-commerce” and the draft Law of Ukraine “On Amending the Code of Ukraine on Administrative Offenses” to establish liability for violations of e-commerce legislation.”
- Perform other ad hoc duties on a regular basis to support MDT in its efforts to develop compliant Ukrainian legislation in the field of e-commerce.
This assignment is expected to require up to 30 working days, beginning on/about September 10, 2021 through October 21, 2021. The assignment will take place in Kyiv, Ukraine.
The required and/or preferred qualifications for the Expert are:
- Advanced degree in a relevant field (law, economics, public administration or other relevant) preferred. Legal expertise required.
- A comprehensive understanding of Ukrainian business environment required.
- Demonstrated experience in e-commerce field required.
- Demonstrated knowledge of EU-Ukraine Deep and Comprehensive Free Trade Areas(DCFTA) and EU legislation relating to e-commerce required.
- Good knowledge of the Ukraine legal environment required.
- At least 5 years of prior work experience in the field of legal analysis preferred.
- Strong analytical, communication, and interpersonal skills required.
