Просимо звернути увагу, що закупівля автотранспортних засобів буде проводитись в рамках міжнародної технічної допомоги для ДСНС України, відповідно кінцевий до цього згідно:
Статті 197.11. Податкового Кодекса України;
Статті 287 Митний кодекс України. Стаття 287;
Статті 6 Закон України про гуманітарну допомогу. Стаття 6;
дані товари (автомобілі) звільняються від оподаткування, від сплати ввізного мита та від сплати акцизу.

Автомобілі, що планується закупити, є гуманітарною допомогою Державній Службі з Надзвичайних Ситуацій України, яка фінансується за проектом UKR-000272 DANIDA SPA 2022 Top-up 3 Danida HUM (Humanitarian Action), Ministry of Foreign Affairs of Denmark 30.04.2023
Постачання автомобілів відбуватиметься на підставі Закону України про гуманітарну допомогу. Буде оформлено тристоронній договір, за яким отримувачем автомобілів виступатиме Державна Служба з Надзвичайних Ситуацій України.
Згідно статті 6 “Звільнення від оподаткування товарів (робіт, послуг), визнаних гуманітарною допомогою”
Визнання товарів (робіт, послуг) гуманітарною допомогою здійснюється спеціально уповноваженими державними органами з питань гуманітарної допомоги у кожному конкретному випадку з урахуванням таких особливостей. (Частина перша статті 6 із змінами, внесеними згідно із Законами № 5463-VI від 16.10.2012, № 640-VIII від 16.07.2015)
Не відносяться до гуманітарної допомоги підакцизні товари, крім:
автомобілів швидкої медичної допомоги, легкових автомобілів спеціального призначення для Міністерства внутрішніх справ України, органів Національної поліції;

транспортних засобів, що надходять у період проведення антитерористичної операції, здійснення заходів із забезпечення національної безпеки і оборони, відсічі і стримування збройної агресії Російської Федерації у Донецькій та Луганській областях для отримання і використання Збройними Силами України, Національною гвардією України, іншими утвореними відповідно до законів України військовими формуваннями, Службою безпеки України, Міністерством внутрішніх справ України, Державною прикордонною службою України, Державною службою України з надзвичайних ситуацій, Державною спеціальною службою транспорту, Державною службою спеціального зв’язку та захисту інформації України для забезпечення проведення антитерористичної операції, здійснення заходів із забезпечення національної безпеки і оборони, відсічі і стримування збройної агресії Російської Федерації у Донецькій та Луганській областях.

The cars planned to be purchased are humanitarian aid to the State Emergency Service of Ukraine, which is financed under the project UKR-000272 DANIDA SPA 2022 Top-up 3 Danida HUM (Humanitarian Action), Ministry of Foreign Affairs of Denmark 04/30/2023
The delivery of trucks will take place on the basis of the Law of Ukraine on Humanitarian Aid. A tripartite agreement will be drawn up, according to which the recipient of the cars will be the State Service for Emergency Situations of Ukraine.
According to Article 6 “Exemption from taxation of goods (works, services) recognized as humanitarian aid”
Recognition of goods (works, services) as humanitarian aid is carried out by specially authorized state bodies for humanitarian aid in each specific case, taking into account such features. (Part one of Article 6 as amended in accordance with Laws No. 5463-VI dated 16.10.2012, No. 640-VIII dated 16.07.2015)
Excise goods are not included in humanitarian aid, except for:
ambulances, special purpose passenger cars for the Ministry of Internal Affairs of Ukraine, National Police bodies;

vehicles arriving during the period of the anti-terrorist operation, implementation of measures to ensure national security and defense, repel and deter armed aggression of the Russian Federation in the Donetsk and Luhansk regions for receipt and use by the Armed Forces of Ukraine, the National Guard of Ukraine, and others formed in accordance with the laws of Ukraine military formations, the Security Service of Ukraine, the Ministry of Internal Affairs of Ukraine, the State Border Service of Ukraine, the State Emergency Service of Ukraine, the State Special Transport Service, the State Service for Special Communication and Information Protection of Ukraine to ensure the conduct of an anti-terrorist operation, the implementation of measures to ensure the national of security and defense, repelling and deterring the armed aggression of the Russian Federation in the Donetsk and Luhansk regions.

Transactions with:
the supply of goods and services in the customs territory of Ukraine and the importation of goods into the customs territory of Ukraine as international technical assistance, which is provided in accordance with international treaties of Ukraine, consent to the binding of which has been given in accordance with the procedure established by law;
supply of goods and services in the customs territory of Ukraine and import into the customs territory of Ukraine of goods financed at the expense of international technical assistance, which is provided in accordance with international agreements of Ukraine, consent to the binding of which has been given in accordance with the procedure established by law;
importation of property into the customs territory of Ukraine as humanitarian aid provided in accordance with the provisions of the Law of Ukraine “On Humanitarian Aid”.

Peculiarities of customs taxation of some goods
1. When imported (forwarded) to the customs territory of Ukraine, goods designated by the Commission on Humanitarian Aid under the Cabinet of Ministers of Ukraine as humanitarian aid in accordance with the Law of Ukraine “On Humanitarian Aid” are exempt from import duty taxation.
Humanitarian aid provided by Ukraine is exempted from payment of export duty when exported outside the customs territory of Ukraine.
